among them, when john roberts voted and you write in the book and i want to read, this is out of the book, quote, by demanding that roberts kill our entire health care law, the four conservative justices prompted them to look for some kind of middle ground. roberts felt obligated to protect the institutional interests of the court, not just his own philosophical agenda. now, doing that, he uncost merrily went against the conservatives, members of the court. >> he certainly did and count me among those who are shocked and predicted wrongly. justice sees himself as the chief justice, as the embodiment of the court and after citizens united, after bush v. gore to do it a third time in a relatively short period of time would have damaged the court and romney found that middle ground under the taxing power of congress and he upheld the law but don't think that john roberts has suddenly. >> a mentor of mine said, be when he said that, he did not find it, they had the right to deal with interstate commerce. >> right. >> but that they could deal with tax law, most of the civil rights

's campaign co-chair former new hampshire governor john sununu describing president obama's debate performance today. >> he has been lazy and disengaged and has no idea, not only of his own policies, but has no idea what mitt romney's real policies are. p. >> you don't think there will be a better prepared president obama on stage next week? >> when you're not that bright, you can't get better prepared. >> lazy. not that bright. this is the president of the united states he's talking about. he was pressed about .comment. >> did you really need to call the president of the united states lazy? >> yes. i think you saw him admit it the night before when he delivered the pizzas. he said, you know, they're making me do this work. he didn't want to prepare for this debate. he's lazy and disengaged. >> now, we've seen this disrespect right from day one. it cannot be tolerated. mitt romney must denounce a n sununu's ugly talk. joining me now, opinion writer from the "washington post," and victoria defrancesco, a fellow at the university of texas and an msnbc contributor. thanks both of you for being he

to come up with an analogy which is for me the de ja vu of this election is 2004. okay? when john kerry couldn't describe his position was on the war of iraq, would he he have voted for it knowing what he knew at that time? how would he get out of it? it's one thing to deliver a critique of a sitting president with big challenges. even if you think that the sitting president is responsible for all of those challenges, as democrats thought about president bushes, they are now thinking about it with president obama. it's easy. when you say, i'm going to make it better, vote for me. people not unreasonably, not laugh blee say, how are you going to do that? what are you going to do? john kerry struggled with that question. mitt romney is struggling with that now. >> that seems to be the problem. what is the message besides we don't like president obama. >> my problem with the campaign is they really need to start delineating between what the obama campaipresidency looks li romney's presidentially will look like. i agree with you, we're getting down to the 11th hour and there's one final deb

john mccain would not let us do in 2008. the plans suggested hiring an extremely literate african-american to sell the message and label the president a metrosexual black abe lincoln. >> yeah. listen, i'm not sure exactly -- >> that's a halloween costume. >> i don't know what they mean by the last comment. but george will who i normally respect, this president has enjoyed the numbers that he is now and despite the rags initialized attacks. the reason this deck was disapproved by romney is because they don't need it. they've had the welfare ads and this strategy has been in place in other ways and it was exposed early enough so folks could see the inner workings behind back room door strategy sessions. >> well, it's playing into that stereotype. angry black man. i know some blacks that are angry that he's not more angry. >> how about that and happy birthday, rev. >> thank you. james peterson, ana marie cox, thank you for your time tonight. >> yep. and happy birthday. >> thank you. >>> still ahead, it all comes down to this. 19 primary debates for romney but none on the biggest stag
